ATC to resume enforcement of vape product restrictions

Beginning today the Louisiana Office of Alcohol and Tobacco Control will resume the enforcement of state laws concerning the marketing and sale of vapor products. Commissioner Ernest Legier said even though the law restricting the sale of products not registered with the state’s VAPE directory is being challenged in court…

“We’ve been advised that the current state of the litigation is such that it is within the state’s right and purview to enforce the act as written,” said Legier.

Enforcement of Act 414, which passed in the 2023 regular session, was paused after a legal challenge. Legier said retailers who sell unregistered products can be fined and…

“Our agents will be seizing that product and holding it for evidence pending a hearing at which time will determine whether or not the evidence supports any citations that are written,” said Legier.

Legier said for products to be included in the state’s VAPE directory they must have an application, pending or approved by the Food and Drug Administration.

He said the legislature passed and the governor signed off on Act 414 to eliminate flavored vape products…

“Which had historically been a concern as it relates to youth access and we are charged as an agency to enforce the laws that are passed by our elected officials,” said Legier.
