LUBBOCK, Texas — A report from the Lubbock Police Department detailed the events leading up to a woman being accused of injuring a child after a toddler smoked her THC vape pen that she said fell out of her pocket.

According to the police report, officers were called to the 2100 block of 33rd Street just before 9:45 p.m. on Sunday.

The report stated police arrived to find the child, mother and another woman on the steps just inside the home speaking to EMS. According to the report, the mom told officers the 2-year-old smoked a vape and had been throwing up.

Police asked for the vapes, and the woman who was sitting with the child and his mom said she threw the vape away after the baby used it. The woman ended up finding the vape, and police asked if it had THC. The woman said she was unsure, the report stated, because she bought the vape for $25 from someone on social media. While officers were speaking with the woman and the mother, the child became “lethargic” and hit his head on a door due to being “impaired.”

According to the report, the woman told police she got up from watching TV when the vape fell out of her pocket. She looked back and saw the child had the vape and appeared to be smoking from it, the report stated. The woman told police she knocked the vape out of the child’s hand. According to the report, the child threw up three times before EMS arrived.

The woman was charged with possession of a controlled substance and causing injury to a child. She was taken to the Lubbock County Detention Center and later posted bond. The police report did not indicate the child’s current status.
