Luverne woman charged with inciting riot over vape pen – The Globe


WORTHINGTON — A Luverne woman is charged with one felony count of rioting while armed with a dangerous weapon following a Feb. 16 incident.

According to the criminal complaint written by the Worthington Police Department, officers were dispatched to a Nobles Street residence at approximately 10:37 p.m. Feb. 16 on reports of a large- scale fight. Officers were advised that one of the individuals involved may have been armed with a pink handgun and that the suspects were seen running toward a vehicle.

Upon arrival at the scene, officers spotted two individuals entering a vehicle in the parking lot. After drawing their duty weapons, the officers approached and ordered the two to exit the vehicle and get on the ground.

Samantha Lively, 19, of Luverne, was reportedly sitting in the driver’s seat. After identifying several other juveniles inside the vehicle, officers discovered a pink handgun on the driver’s floorboard. The weapon’s magazine contained multiple pepper balls with one in the chamber.

Officers entered the apartment complex where the incident was reported to have taken place and spoke with some of the first floor tenants, who indicated the fight took place on the second floor. One resident told officers they had observed a woman with a pink handgun moments prior.

A juvenile victim of the fight was observed on the second floor, holding an icepack to their ribs, their knuckles bloody.

According to the report, the victim told officers that Lively came to the building to fight one of the victim’s juvenile peers over a vape pen. They had gone out the front door of the building to hand Lively the vape pen when Lively and a group of girls allegedly began to beat the victim.

The victim said when they saw Lively pull out her handgun, the victim returned inside the building and went upstairs to a friends’ apartment. One of the juveniles allegedly followed and hit the victim repeatedly before tasing them, causing the victim to punch a hole into the apartment drywall and shout for help.

After this, the juveniles and Lively were observed running to their car. Testimonies from other apartment residents allegedly state they saw Lively pointing a pink handgun at the victim.

If convicted, Lively faces a maximum of five years in prison and/or a $10,000 fine.
