Middleburg Heights extends vape/smoke shop moratorium


MIDDLEBURG HEIGHTS, Ohio – An existing temporary moratorium on the establishment of new vape and smoke shops in Middleburg Heights has been extended for six more months.

City Council passed the extension at its April 23 meeting.

The city will not accept or approve any new applications, permits, variances or zoning applications for vape and smoke shop businesses while the moratorium remains in effect.

Council first established the freeze in June 2023, citing a need to review industry information on the effects of vaping and e-cigarettes, as well as to determine which city ordinances and zoning codes would need revised for those businesses to set up shop in Middleburg Heights. The moratorium was then extended for another six months in late November.

City zoning codes underwent an overhaul last year, and Mayor Matt Castelli and City Council continue to work with the Law Department and city planner to decide which business areas are best suited for new vape and smoke shops.

“We are just reissuing the moratorium,” Castelli told council prior to the April 23 vote. “As you know, we’ve been working on reviewing the zoning as it relates to vape and smoke shops and establishments.

“We need additional time before we’re able to come to City Council with some suggestions.”
